Be it remembered that on this 5th day of March A.D. 1906 of the Jennings Circuit Court the following last Will and Testament of James Waughtel deceased, was admitted to probate in the office of the Clerk of said Court to-wit:

In the Name of the Benevolent Father of all I make and publish this my last Will and Testament, revoking all former Wills and Codicils.

First I give and Bequeath to my wife Nancy all my personal property and all my Real Estate Consisting of Five Hundred and Five acres situated in Geneva Township Jennings County and State of Indiana, with all profits accruing thereon during her Natural life time.

Second After her (my wife Nancy) death I will that all my property both real and personal that she leaves after all debts are paid Be divided betwwen my Children, or sold and the Money divided in the following proportions WITH exceptions hereafter named.

1st to my Son James $500.00      Five hundred Dollars
2d " " " Charles $650.00 Six hundred and fifty Dollars
3rd " " " Abram $1400.00 Fourteen hundred Dollars
4th " " Daughter Belle Patton $900.00 Nine hundred Dollars
5th " " " Genette Couchman $950.00 Nine hundred Dollars
My sons Josiah and John having each received One Thousand dollars. I will
that each of my children named receive an equal amount. Abram Excepted.

Third After each have received the amount herein set forth that if there be any remaining that it be Equally divided between my Children all ready named.

Fourth To my son George I will that he have after my wife Nancy death, the following Real Estate, to-wit: The North half of the south West quarter of Section 28, Town 8, Range 7. Also 5 acres in the North West Corner of the south half of the above named quarter Section and situated in said Geneva Township, to hold and possess, with all profits accruing thereon during his Natural life time and after his death the above described Real Estate be divided between the balance of my Children and their heirs Equally.

Fifth I herein Name and appoints Isaiah L. Green of Scipio, Indiana, Executor of this my last Will and Testament.

                               Proof of Probate of Will

State of Indiana, Jennings County, ss

Before me Willard New Judge of the Jennings Circuit Court, personally came Charles T. Green one of the subscribing Witnesses to the foregoing last Will and Testament of James Waughtel, late of Jennings County, Indiana, deceased, and having duly sworn on Oath says that he was present at the execution of said last will: that the same was duly executed: that at the time of the execution thereof: said testator was of full age to devise his property, of sound mind and memory and not under any Coercion or restraint: that said testator requested affiant and Clem Waughtel to sign said will as Witnesses thereto, which they accordingly did in the presence of each other and subscribing witnesses thereto.

             Jennings County, ss:

I John Hulse Clerk of the Jennings Circuit do hereby Certify that the above and foregoing last Will and Testament of James Waughtel late of Jennings County Indiana, deceased, was this day duly admitted to probate and record, and the proof have been duly recorded in Will Record No. 5 page 262 - 264 in this office.

                         Witness my Name and Seal of said Court.
