WILL AND PROBATE OF THOMAS SINEX
aka
Thomas William Sinex
RECORDS OF WILLS, EXECUTORS' BONDS,
WASHINGTON COUNTY, STATE OF INDIANA
In the name of the benevolent Father of all. I Thomas Sinex of the
County of Washington in the State of Indiana do hereby make, declare,
and publish this my last will and testament.
First I give devise and bequeath unto my beloved wife Flora all and
singular the household and kitchen furniture moveable property goods and
chattels in and upon the premises occupied by me in said Washington
County (excepting the furniture in the rooms occupied by my son Elisha)
to have and to hold the same unto her and her assigns absolutely
forever.
Second. I give devise and bequeath unto my said wife the use interest
and dividends of and arising from the sum of two thousand dollars loaned
by me to J. Bragdon & Co and and from all of my stocks in the Merchants
National Bank of New Albany amounting at its par value to Thirty five
hundred dollars, to have and to hold the same unto her own sole separate
and exclusive use, for and during the term of her natural life, she
paying the taxes upon the same.
Third I hereby will and direct that all of my real estate wherever
situated be sold as soon after my decease as practicable and that the
proceeds of such sale be applied as follows.
First, To the payment of all my just debts including the expenses of
administration.
Second, That the remainder of such proceeds of sale be divided and I
give and devise the same as follows. To Jane Woodville, my eldest
daughter one seventh after deducting therefrom one hundred dollars which
I have advanced for her, to my son Thomas H. Sinex one seventh , to my
son William G. Sinex one seventh deducting therefrom the sum of five
hundred dollars which I have advanced for him and which is evidenced by
the promissory note of his wife.
To Elisha W. Sinex one seventh deducting therefrom the notes I now hold
against him amounting in the aggregate to something more than one
thousand dollars; to Maria L. Collins one seventh; to Zerelda Spence one
seventh; to my granddaughter Mittie F. Sinex subject to the conditions
hereinafter mentioned. I give the use, and interest of and upon one
seventh of the proceeds of the sale of my said real estate deducting
therefrom two hundred dollars which I paid out for the funeral expenses
and of my son Albert until she becomes twenty one years of age or
marries, to wit: at her attaining her majority or marrying.

I direct that said one seventh of the proceeds of the sale of said real
estate subject to the deduction aforesaid and that condition hereinafter
mentioned be paid to her. should said one seventh of the proceeds of
said sale after deducting said sum of two hundred dollars, exceed one
thousand dollars, then I give and devise such excess over one thousand
dollars to my daughter in law Christa E. Sinex and her assigns forever.
I further will and direct that the amount herein given and bequeathed to
my said granddaughter be paid to and held by my friend Alexander Dowling
in in trust for my said grand child, Mittie F. Sinex and direct the said
trustee to pay over the principal thereof to her on her attaining the
age of 21 years or marrying, and I further will and direct that the
interest therein be paid by said trustee from time to time during the
minority of my said grand child to her mother or guardian for her
education and maintenance.
I give and devise to my son Elisha W. Sinex the household furniture in
the rooms ocupied by him and his family in the house where we reside in
Washington County, Indiana.
I give devise and bequeath my vault in the Northern Cemetery at New
Albany Indiana unto my wife and children and their children for their
use forever. I give and devise my scholarship in Asbury University at
Greencastle Indiana unto my son William G. Sinex and his heirs and
assigns forever. I give my gold headed cane unto my son Thomas H. Sinex
during his life, then to William G. Sinex during his life, then to
Elisha W. Sinex during his life and then unto my grandson Thomas Sinex
son of Elisha forever.
At the death of my said wife Flora I will and direct that all that part
of my estate of which the use is hereby given to her be divided equally
among and between my said children. Should my said wife find that the
provisions I have made for her in this will is inadequate for her
comfortable maintenance and support, then I authorize, will and direct
that she may take, use and dispose of and expend so much of the money
and stock, the use of which I have hereinbefore devised to her, as she
may think necessary without accounting therefor to any one, and all
receipts for the

sales and assignments of said stock made by or given by her shall be as
binding and effectual as if said money and stock had been in the first
instance and unconditionally devised to her and her assigns forever.
I hereby direct that nothing be taken into account or changed against
any of my children except the sums and advances herein particularly
referred to or mentioned. All the rest residue and remainder of my
estate I give and bequeath unto my said children to be divided amongst
them share and share alike.
I hereby revoke all other wills by me at any time made.

Be it remembered that on the 19th day of September 1870 Alexander
Dowling one of the subscribing witnesses to the within and foregoing
last will and testament of Thomas Sinex late of said County deceased
personally appeared before the clerk of the Court of Common Pleas of
Washington County in the state of Indiana and being duly sworn by the
Clerk of said County declared and testified as follows, that is to say
that on the 17th day of May 1870, he saw the said Thomas Sinex sign his
name to said instrument in writing as and for his last will and
testament and this deponent at the same time herd the said Thomas Sinex
declare the said instrument in writing to be his last will and
testament, and the the said instrument in writing was at the same time
at the request of the said Thomas Sinex and with his consent and
subscribed by the said Deponent & W. Sullivan in the presence of said
testator and in the presence of each other as subscribing witnesses
thereto and that the said Thomas Sinex was at the time of signing and
subscribing of said instrument in writing as aforsaid of full age (that
is more than twenty one years of age) and of sound

County Indiana do hereby certify that the within annexed will and
testament of Thomas Sinex has been duly admitted to probate and duly
proved by the testimony of Alexander Dowling one of the subscribing
witnesses thereto that a complete record of said will, and of the
testimony of said Alexander Dowling in proof thereof has been by me duly
made and recorded in book C at page 604 of the record of wills of said
County.
In attestation whereof I have hereunto subscribed my name and affixed
the seal of said County at Salem this the 19th day of September 1870.

Thaddeus Terrell, Madison Blankenbaker of said County are held and
firmly bound unto the State of Indiana in the penal sum of Sixteen
Thousand dollars for the payment of which we jointly and severally bind
ourselves our heirs executors and administrators Sealed with our seal
and dated this 21st day of February in the year of our Lord One Thousand
eight hundred and Seventy one. The condition of the above obligation is
that if the above bound Elisha W Sinex shall faithfully discharge the
duties of his wish as administrator with will annexed of the estate of
Thomas Sinex deceased according to law then the above obligation to be
void else to remain in full force.

Know all men by these presents, That we Alfred B. Collins & Flora Sinex
are held and firmly bound unto the State of Indiana, in the penal sum of
Seven Thousand Dollars, for the payment of which we jointly and
severally bind ourselves, our heirs, executors and Administrators.
Sealed with our seals, and dated this 18 day of July in the year of Our
Lord One Thousand Eight Hundred and Seventy Eight. The condition of the
above obligation is That if the above bound Alfred B. Collins shall
faithfully discharge the duties of his trust as Administrator [De Bonis
non] of the Estate of Thomas Sinex deceased with the Will annexed
according to law, then the above obligation to be void, else to remain
in full force.

Thomas SINEX (aka Thomas William Sinex) and wife Flora (nee WEST) were
my third great-grandparents. Thomas (aka Thomas William) is also my 3rd
